Dr. Aafia Convicted of trying to kill Americans – That’s why we hate YOU -Americans

NEW YORK—A U.S.-trained Pakistani scientist was convicted Wednesday of charges that she tried to kill Americans while detained in Afghanistan in 2008, shouting with raised arm as jurors left the courtroom: “This is a verdict coming from Israel, not America.”

A jury deliberated three days in federal court in Manhattan before finding Aafia Siddiqui guilty in the third week of her attempted murder trial, which she often interrupted with rambling courtroom outbursts.

After declaring the verdict came from Israel, she turned toward spectators in the packed courtroom and said: “Your anger should be directed where it belongs. I can testify to this and I have proof.”

Siddiqui, 37, was convicted of attempted murder, though the crime was not found by the jury to be premeditated. She was also convicted of armed assault, using and carrying a firearm, and assault of U.S. officers and employees.

Before her arrest, U.S. authorities had called Siddiqui an al-Qaida sympathizer. She was never charged with terrorism, but prosecutors called her a grave threat who was carrying bomb-making instructions and a list of New York City landmarks including the Statue of Liberty when she was captured.

The defendant—a spindly neuroscience specialist who trained at the Massachusetts Institute of Technology and Brandeis University—”is no shrinking violet,” Assistant U.S. Attorney Christopher La Vigne said in closing arguments.

“She does what she wants when she wants it,” he said. “These charges are no joke. People almost died.”

Testifying in her own defense, Siddiqui claimed she had been tortured and held in a “secret prison” before her detention. Charges that she attacked U.S. personnel who wanted to interrogate her were “crazy,” she said. “It’s just ridiculous.”

In court, Siddiqui veiled her head and face with a white scarf and often sat slumped in her chair. She openly sparred with the judge and her own lawyers, insisted she could single-handedly bring peace to the Middle East and lashed out at witnesses in tirades that got her kicked out of the courtroom.

“I was never planning a bombing! You’re lying!” she yelled while an Army captain testified.

In her closing argument, defense attorney Linda Moreno accused the prosecutors of trying to play on the jury’s fears.

“They want to scare you into convicting Aafia Siddiqui,” she said. “The defense trusts that you’re much smarter than that.”

During the two-week trial, FBI agents and U.S. soldiers testified that when they went to interrogate Siddiqui at an Afghan police station, she snatched up an unattended assault rifle and shot at them while yelling, “Death to Americans.” She was wounded by return fire but recovered and was brought to the United States to face charges attempted murder, assault and gun charges.

A chief warrant officer, who testified in uniform but did not give his name, told jurors he had set down his M4 rifle after being told Siddiqui had been restrained. He testified he was shocked when she suddenly appeared from behind a curtain wielding his M4 rifle and yelling, “Allah akbar,” Arabic for “God is great.”

“It was pretty amazing she got that thing up and squared off,” he said. “She was looking at me and aiming dead at me.”

Hearing the rifle go off, the officer said he followed his military training and pulled his pistol. Siddiqui was wrestling with an interpreter when he shot her in the stomach.

“I operated within the rules of engagement to eliminate the threat,” he said.

The defense told jurors there was no ballistic, fingerprint or other physical evidence proving the weapon was “touched by Dr. Siddiqui, let alone fired by her.”

Siddiqui testified she was shot shortly after she poked her head around a curtain to see if there was a way she might slip out of the room where she was being held. She said she was desperate to escape because she feared being returned to a secret prison.

“I wanted to get out. … I was afraid,” she said.

    عافیہ صدیقی کو افغانستان میں امریکی فوج اور حکومت کے اہلکاروں پر مبینہ طور قاتلانہ حملے اور قتل کی کوشش کرنے کے سات الزامات میں مجرم قرار دیا ہے۔

    ڈاکٹر عافیہ پر الزام تھا کہ انہوں نے سنہ دو ہزار آٹھ میں جب وہ افغانستان میں حراست کے دوران امریکی فوجیوں کو ہلاک کرنے کی کوشش کی تھی۔ ڈاکٹر عافیہ نے الزامات کی تردید کی تھی۔

    نیویارک میں مقدمہ سننے والی جیوری نے سینتیس سالہ عافیہ کو اقدام قتل کا مجرم قرار دیا تاہم ان پر منصوبے کے تحت قتل کرنے کی کوشش کا الزام ثابت نہیں ہوا۔

    استغاثہ نے کہا کہ ڈاکٹر عافیہ نے کیمیائی اجزاء اور نیویارک میں حملے کے بارے میں تحریروں کی برآمدگی کے بارے میں سوال پوچھے جانے پر رائفل اٹھا لی فوجیوں پر گولیاں چلائیں۔حملے میں کوئی امریکی زخمی نہیں ہوا تھا۔

    ڈاکٹر عافیہ کو جولائی دو ہزار آٹھ میں افغان پولیس نے کیمیائی اجزاء رکھنے اور ایسی تحریریں رکھنے پر گرفتار کیا تھا جن میں نیویارک پر حملے کا ذکر تھا جس میں بھاری جانی نقصان ہونا تھا۔ ان پر القاعدہ کی قیادت سے رابطوں کا بھی الزام ہے۔

    جب جیوری اراکین کی جانب سے فیصلہ سنایا گیا تو ڈاکٹر عافیہ صدیقی عدالت میں موجود تھیں اور اپنے خلاف فیصلہ سنائے جانے کے بعد انہوں نے کہا کہ ’میں جانتی ہوں کہ یہ فیصلہ امریکہ کا نہیں کہیں اور سے آیا ہے‘۔

    ڈاکٹر عافیہ پر ثابت الزامات میں انہیں متوقع طور پر تیس سے پینتیس سال قید کی سزا ہوسکتی ہے۔ تاہم امریکی نظام انصاف میں سزا کا تعین جیوری نہیں بلکہ جج کرتا ہے اور اس مقدمے میں جج رچرڈ برمین نے فیصلے کی تاریخ چھ مئي مقرر کی ہے۔

    ڈاکٹر عافیہ کے دفاع کے لیے پاکستانی حکومت نے بھی تین دفاعی وکلاء مقرر کیے تھے۔ ڈاکٹر عافیہ صدیقی کی ایک دفاعی وکیل ایلین شارپ نے فیصلے کے بعد میڈیا سے بات کرتے ہوئے کہا کہ ڈاکٹر عافیہ صدیقی کے خلاف فیصلہ غلط ہے کیونکہ ان کے خلاف کوئی فورینزک گواہی نہیں ملی تھی جبکہ ان کے خلاف فیصلہ حقائق پر نہیں خوف کی بنیاد پر کیا گیا ہے‘۔

    ڈاکٹر عافیہ کے ایک اور وکیل چارلس سوئفٹ نے جیوری کے فیصلے کے بعد عدالت کے باہر میڈیا سے بات چیت کرتے ہوئے کہا کہ انہیں اس فیصلے سے دکھ پہنچا ہے لیکن انہیں امریکی نظام انصاف پر یقین ہے اور وہ فیصلے کے خلاف اپیل کریں گے۔

    ڈاکٹر عافیہ کے خلاف مقدمے کی باقاعدہ سماعت سے قبل ان کے وکلاء کا موقف تھا کہ وہ مقدمہ چلائے جانے کے لیے ذہنی طور اہل نہیں تاہم نفسیاتی معائنے کرنے والے ماہرین کے معائنہ جات اور آزادانہ رپورٹوں کے بعد فیصلہ دیا گیا تھا کہ ڈکٹر عافیہ صدیقی مقدمہ چلائے جانے کے لیے ذہنی طور اہل ہیں۔

    اس مقدمہ کی باقاعدہ سماعت انیس جنوری سے شروع ہوئي تھیں اور اکیس دن کے اندر استغاثہ اور دفاع کو گواہیاں سننے کے بعد بارہ رکنی جیوری نے انہیں امریکی فوجیوں ، حکومتی اہلکاروں اور ان کے مترجموں کو قتل کرنے کی کوشش اور اس کیلیے ایم فور رائفل اٹھانے اور ان پر فائر کرنے کا مجرم قرار دیا۔

  5. I don’t know as to how the jury found Aafia guilty when the prosecuion failed to provide any evidence of finger-prints or firinig from the gun? This decision has blemished the face of America. Aafia was kidnapped from Pakistan(Musharraf managed for it), tortured in Afghanistan and now declared her guilty in America. The US will get nothing of this cruel decision

    • she was held from 2003 to 2008 without trial and her three kids.I dont comment on jury decision but I really feel sorry for her three kids are they also involved in any crime for which they were held during this time.

    I am extremely sorry for what these bastards Americans and there dogs have done to you, i wish i can do something and get you out of these American – Israeli prison.
    my sister in Islam our ummah is sleeping and very busy in duniya, money, western society and alcohol. They have completely forgotten Quran and sunnah.
    They have forgotten that we should help Muslim brother and sister in trouble.
    but dont worry there are some Muslims, whom they have named jihadis, fundamentalist and extremist…we are proud of being all these 3 categories. We will take revenge for every sin that they are doing against Islam. But the best part is the more they are torturing us, the more we become strong headed.
    The day is not far away when we will strike with full force and every hadees of our prophet will be implemented and then only our so called modern Muslim will also join in this last battle against imperialism. Inshallah.
    To my fellow Pakistani Muslims, plz dont sell your mother for the sake of money, you will be ask on the day of judgment what you have given to Islam.

  10. She’s clearly guilty. I notice that a lot of you seem to think she’s the victim of some American conspiracy (why?). I also notice that many of you believe in war against America. This is so obviously inconsistent. Why not accept that she was like those of you who embrace that war, that, unlike you, she put her principles into practice, and that now she pays the consequences? You guys are mostly seriously troubled souls, and are so wrong about so much, it’s sad, but its also dangerous and self destructive.
